We build a range of services that shall help our users to experience video content in a better way. Our Services include:

  • Websites and web apps, like the Snipedy webportal
  • Messenger Extensions and Bots, e.g. for Apple iMessage and Telegram
  • Products that are integrated with our API into third-party apps and websites

The protection of your personal data is very important to us. Therefore, we process your data exclusively on the basis of the legal regulations (DSGVO, TKG 2003). This Privacy Policy is meant to help you understand what information we collect, why we collect it, and what rights you have in connection with processing them.

In order to make our privacy policy as understandable as possible, we have endeavored to describe the most important things as clearly as possible and provide examples. If you still have questions, feel free to contact us.

1. Information Snipedy collects

We collect information to provide the best experience to all our users. The information we collect, and how that information is used, depends on how you use our Services.

When you’re not signed in to a Snipedy Account, we anonymously store the information we collect with unique identifiers. When you’re signed in, we also collect information that we store with your Snipedy Account, which we treat as personal information.

1.1 Things you create or provide to us

When you create a Snipedy Account, you provide us with personal information, including your email address and password. You can also add more details such as name, website, address and description in your account. If you are not signed in with any Snipedy Account, you may also provide us with information, such as an email address, to receive notifications and updates to our Services.

If you choose to sign in with your Facebook or Google Account, we will receive your name, email address and profile picture from these linked accounts.

We also collect the content you create or receive from others when using our Services. This includes, for example, video snippets (Snips) that you create and save, and comments that you write about Snips.

1.2 Data we collect when you use the Snipedy Services

1.2.1 Your apps, browsers & devices

We collect information about the apps, browsers, and devices you use to access Snipedy Services, which helps us provide features like automatic product updates or finding out any problems such as dead links, search engine problems or unpopular pages.

The data we collect includes browser type and settings, device information and their operating system. In addition, we also collect data about the use of your apps, browsers and devices in connection with our Services. These include, but are not limited to, the IP address, crash reports, system activity, and the date, time, and referral URL of your request.

In particular, we process the following information:

  • Cookies
  • Anonymized IP addresses by removing the last 2 bytes
  • Pseudo-anonymized location (based on the anonymized IP address)
  • Date and Time
  • Title of the accessed page
  • URL of the accessed page
  • URL of the previous page (if allowed)
  • Screen resolution
  • Local time
  • Files that were clicked and downloaded
  • External links
  • Loading time of the page
  • Country, region, city (low accuracy due to IP address)
  • Main language of the browser
  • User Agent of the browser
  • Interaction with forms (but not their content)

1.2.2 Your Activity

As part of our Services, we also collect information about your activities. This data is completely anonymized assigned to a unique identifier and used only for analysis purposes.

The activity information we collect may include:

  • Terms you search for
  • Snips you watch
  • Views and interactions with content like Micro-Moments
  • Purchase activity
  • Activity on third-party sites and apps that use our Services

1.3 Information external services collect as you use our Services

1.3.1 YouTube

Snipedy uses the YouTube Embedding feature to view and play videos from YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA (“Youtube”).

By accessing pages of our website that have integrated YouTube videos, data is transmitted to YouTube, stored and evaluated. When you’re logged in to Google, your data will be assigned directly to your personal account.

1.3.2 Amazon

Snipedy is a participant in the Amazon Affiliate Program, which enables placement of product links to earn advertising reimbursement. In order to understand the origin of orders, Amazon uses cookies.

Responsible for the purposes of data protection laws are Amazon Europe Core S.à.r.l. and Amazon EU S.à.r.l., located 5, Rue Plaetis, L-2338 Luxembourg and Amazon Instant Video Germany GmbH, Domagkstr. 28, 80807 Munich (“Amazon”). Amazon Deutschland Services GmbH, Marcel-Breuer-Str. 12, 80807 Munich, will act as data processor on their behalf.

1.3.3 Mailchimp

We send out newsletters with, and use features of, the newsletter service “MailChimp” of The Rocket Science Group, LLC, 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308 USA (“Mailchimp”) on this website to record newsletter signups.

By registering for our newsletter, the information entered will be stored on the Servers of MailChimp. In addition, after receiving a newsletter, information such as IP address, browser type and Email client will be stored and processed on their servers, to give us information about the performance of our newsletter.

MailChimp is an active participant in the EU-US Privacy Shield Framework, which regulates the correct and secure transfer of personal data. We have a contract with MailChimp for Data Processing which is regulated in their Data Processing Addendum. This agreement is designed to safeguard your personal information and to ensure that MailChimp adheres to applicable privacy policies and does not share your personal information with third parties. 2. Purposes

We use the information we collect from our Services for the following purposes (the “Purposes”):

2.1 Provide and improve our Services

Examples:

  • Processing your search queries to show search results
  • Ensuring the proper functioning and improvement of our Services
  • Checking technical issues
  • Eliminate user reported issues with our Services

2.2 Develop new services

Examples:

  • direct feature requests
  • analysis of patterns in behavior

2.3 Provide personalized services, including content and direct advertisement

Examples:

  • Provide recommendations, personalized content and personalized search results; or
  • Email information about new features, services, and the latest Snips

2.4 Provide measurements, analysis and other business services

  • Data analysis of your visits to our website to improve the design of the service; or
  • Collecting activity data to help our partners better understand their campaigns

3. Legal basis

The processing of your data is based on the legal basis of consent in accordance with Art. 6 (1) (a) GDPR if you expressly consent to the processing of the data, for example when registering for our newsletter.

Further legal basis of the data processing is the fulfillment of the contract according to Art. 6 (1) (b) GDPR in order to provide you with a seamless user experience when using our Services.

In addition, we process your information in order to safeguard our legitimate interests or of third parties according to Art. 6 (1) (f) GDPR.

For example, your name and Email address are processed in order to clearly identify you and avoid confusion. For example, we can ensure that we have only entered you once in our database. Our legitimate interest in processing your data also exists for our own and third-party marketing purposes, for performance optimization or legally permissible direct advertising (e.g. in the context of our Email newsletter).

4. Security measures

The data processes by us are protected against unauthorized access by means of data security measures (encrypted transmission, pseudonymization of the data, role authorization concept, data protection concept, reliability). The security measures are continuously revised in line with technological developments.

5. Data usage and transfer

5.1 Data usage

We use the information you have provided to us as a user of the Snipedy Services only for the Purposes. This data is processed exclusively in data centers in the EEA area.

5.2 When you share your information

Many of our Services let you share information with other people. For example, by creating a Snip, you share data in public with the community. Keep in mind that search engines may also be able to access this data. When you’re signed in and interact with our Services, like leaving comments on a Snip, your name and profile picture appear next to your activity.

5.3 When Snipedy shares your information

We may share non-personally identifiable information with the public and our partners, including publishers, advertisers, developers or rights owners. For example, we share information publicly to show trends about the general use of our Services.

Other data will only be transmitted or forwarded by us to third parties, if necessary for the Purposes, at the request of domestic authorities, on the basis of judicial decisions or if you, as the user of our Services, have previously consented. A transmission for the Purposes concerns for example our transmission of the data to a server in the European Union or to a company that processes your data on our behalf (data processors).

5.4 Receiver

Data collected by us are transmitted to the following data processors:

  • YouTube
  • Amazon; and
  • MailChimp

Information about these recipients can be found in point 1.3.

6. Duration of storage & deletion

6.1 Duration

We store your data for the Purposes of maximum until deletion of your user account and as long as your legitimate interests do not prevail (in particular, if you have objected, see below).  In addition, your data will only be stored to the extent required by law (e.g. due to warranty, statute of limitations and retention periods) or otherwise required.

6.2 Deletion

Your data will be deleted if you (a) revoke your consent to the storage, (b) the data for the fulfillment of the usage agreement regarding the Snipedy Services is no longer required, or (c) the storage is inadmissible for other legal reasons, is or will be. Data whose storage is legally required (e.g. for billing purposes) is not affected by a request for cancellation.

7. Automated decision-making

We do not use automated decision making or profiling according to Art. 22 GDPR.

8. Your rights in connection with processing your data

8.1 Exercise of legal rights

In order to exercise rights in accordance with points 8.2 to 8.6, please send a request to privacy@snipedy.com , the postal address or the telephone number given in the imprint.

8.2 Right of access, information and rectification according to Art. 13-16 GDPR

You can ask us for information about whether and what data we have stored about you and receive copies of this data. You may request the correction of incorrect data at any time. If your data is incomplete, you can request a completion. If we have passed on your data to third parties, we will inform them – if this is legally required – of the correction.

8.3 Right of cancellation of data according to Art. 17 GDPR

You are entitled to demand the immediate deletion of your data for the following reasons:

  • Your data is no longer needed for the purposes for which you were collected
  • You revoke your consent and there is no other legal basis
  • They object to processing and there are no legitimate grounds for processing
  • Your data was processed unlawfully
  • Your data must be deleted to comply with legal requirements

8.4 Right to restriction of processing according to Art. 18 GDPR

You are entitled to request a limitation of the data processing for the following reasons:

  • You deny the accuracy of your data (for the duration that allows us to verify the accuracy of the data)
  • The processing is not lawful and instead of deletion you require a restriction of use
  • We no longer need your data for processing purposes, but you need them for the establishment, exercise or defense of legal claims.
  • You have objected (as long as it is not clear whether your interests prevail)

8.5 Right to data portability according to Art. 20 GDPR

You may use the information you have given us in a structured, common and machine-readable format.

8.6 Right to object in accordance with Art. 21 GDPR

If we process your data on the basis of legitimate interests or in the public interest, you have the right to object to the processing of your data for reasons that arise from your particular situation.

In the event of an objection, we will no longer process your data unless

  • we can prove compelling grounds for processing worthy of protection which outweigh your interests, rights and freedoms or
  • the processing serves the assertion, exercise or defense of legal claims.

8.7 Right to appeal

You are entitled to file a complaint with the competent data protection supervisory authority. For Austria this is the Austrian Data Protection Authority (www.dsb.gv.at).

9. Cookies

9.1. What are Cookies?

Our Services use Cookies. Cookies are small text files that are sent when you visit a website and stored on the user’s and/or customer’s hard drive. If a user/customer visits our website’s server again, the user’s and/or customer’s browser sends the previously received cookie back to the server. The server can then evaluate the information obtained by this procedure in various ways. Cookies can be used for example to control advertising on a website or to facilitate the navigation on such.

9.2 Prevent cookies

If the user and/or client wishes to block the use of cookies, this can be done locally by changing the settings in the internet browser on the user/client’s computer, i.e. the program which opens and displays websites (e.g. Internet Explorer, Mozilla Firefox, Opera or Safari). However, the deactivation of cookies can lead to a faulty  representation of the respective website. Already set cookies can be deleted by users manually by removing them from the folder of the corresponding storage medium or via the browser settings. Further information can be found in the Help menu of the internet browser that is used.
